Understanding EHS Compliance

What Is EHS Compliance?

EHS compliance means meeting every environmental, health and safety legal obligation that applies to your organisation, and being able to prove it. It covers pollution and waste law, occupational health and safety law, and the many sector-specific rules that sit alongside them.

It matters because the consequences of getting it wrong are real: prosecution, fines, imprisonment for serious safety breaches, plant closure notices, and loss of consents. Compliance is also a formal requirement of the compliance-obligations clauses of ISO 14001 and ISO 45001, and a standard demand from lenders, insurers and customers.

The same discipline is called HSE compliance or SHE compliance in some industries. It is the same work. EHS legal compliance is distinct from a broad ehs audit: compliance is measured strictly against the letter of the law, which is what this service does.

EHS Compliance, In One Line

Know which laws apply, prove you meet them through a compliance audit, and stay current as they change. The output is a live legal register, an audit report with a close-out plan, and a trained team.

The Legal Landscape

The Indian EHS Legal Framework

More than a hundred central and state EHS laws can apply to a single industrial site. The first job of compliance is knowing which ones apply to you. These are the main pillars.

Environmental Law

  • Environment (Protection) Act 1986, the umbrella law
  • Water Act 1974 and Air Act 1981
  • Hazardous, biomedical, plastic and e-waste rules
  • CPCB and State Board Consent to Establish and Consent to Operate

Occupational Health and Safety

  • Occupational Safety, Health and Working Conditions Code 2020
  • In force since 21 November 2025, consolidating the Factories Act 1948 and twelve other central labour laws
  • State rules still being finalised through 2026
  • Applies to establishments with ten or more workers

Sector-Specific

  • Explosives and petroleum rules under PESO
  • Electricity, fire and building safety rules
  • Building and construction workers law
  • State factory rules and local by-laws

The environmental pillar is administered by the Central Pollution Control Board and the State Boards. The health and safety pillar changed materially with the Occupational Safety, Health and Working Conditions Code 2020, which is why a current legal register matters more than ever.

Pillar 1

EHS Legal Register and Compliance Management

The legal register is the backbone of EHS legal compliance. We build yours from an applicability assessment, keep it in plain English, and maintain it as the law changes.

Build

Applicability Assessment

We screen every central and state EHS law against your sector, sites and activities, so the register holds only what actually applies to you.

Translate

Plain-English Obligations

Each legal requirement is written as a clear, actionable obligation with an owner, not left as dense legal text.

Maintain

Change Management

When the law changes, we update the register and flag what it means for you, so nothing is missed. This supports the compliance-obligations requirement of your integrated management system.

Pillar 2

EHS Compliance Audit

An EHS compliance audit measures you strictly against your legal register: are you meeting each obligation, and where are the gaps? We run it on Consultivo ProtoSafe, the same audit platform behind our full EHS audit, so scoring is objective and non-conformances are prioritised for close-out.

FAQ

EHS Compliance, Your Questions Answered

What is EHS compliance?

EHS compliance means meeting every environmental, health and safety legal obligation that applies to your organisation, and being able to prove it. It spans pollution and waste law, occupational health and safety law, and sector-specific rules. It is also a formal requirement of ISO 14001 and ISO 45001 and a standard demand from lenders and customers.

What is an EHS legal register?

An EHS legal register is a structured, applicability-screened list of the environmental, health and safety laws that apply to your specific sites and activities, each written as a clear obligation with an owner and a compliance status. It is the backbone of EHS legal compliance and is kept current as the law changes.

What is an EHS compliance audit?

An EHS compliance audit measures your organisation strictly against your legal register: whether you meet each legal obligation, and where the gaps are. Consultivo runs it on the ProtoSafe platform, producing objective scoring, prioritised non-conformances and a close-out plan. It is a distinct service from focused OHS legal, environmental or safety audits, which we also provide.

How is EHS compliance different from an EHS audit?

An EHS audit is a broad, independent check of your environment, health and safety systems and performance against good practice and standards. EHS compliance is narrower and legal: it measures you strictly against the exact statutory and regulatory requirements that apply. The two run on the same ProtoSafe platform, and most organisations need both. For the full performance audit, see our EHS audit.

Which EHS laws apply in India?

The main pillars are the Environment (Protection) Act 1986, the Water Act 1974 and Air Act 1981 with their waste and consent rules administered by the CPCB and State Boards, and, for health and safety, the Occupational Safety, Health and Working Conditions Code 2020, which came into force on 21 November 2025 and consolidates the Factories Act 1948 and twelve other central labour laws. Sector-specific rules for explosives, electricity, fire and construction also apply. Exactly which laws apply depends on your sector, activities and location, which is what an applicability assessment establishes.

Do you provide EHS compliance training, and how long is it?

Yes. We run in-house, customised EHS compliance training on the specific legal requirements that apply to your sites, typically over one to two days, delivered onsite or online. Course content is drawn from your own legal register so your team learns the obligations that actually apply to them.

What is HSE compliance and SHE compliance?

HSE compliance (health, safety, environment) and SHE compliance (safety, health, environment) are the same discipline as EHS compliance, with the letters ordered differently by industry and region. Consultivo delivers the same legal register, compliance audit and training whichever term your organisation uses.
